1. INTRODUCTION
The Automatic Cashback Terms and Conditions set forth the rules, rights, and obligations governing the use of the Automatic Cashback Service in the Macadam Application.
Macadam encourages the User to read these Automatic Cashback Terms and Conditions carefully, along with the Automatic Cashback Privacy Policy, to understand how the User’s Personal Data is managed and its rights.
If the User has any questions or concerns, Macadam support team is available to assist. The contact details provided in Clause 12.11 “Contact” of the Terms and Conditions of Use of the Macadam Platform shall be used for this purpose.
These Automatic Cashback Terms and Conditions constitute an integral part of the Terms and Conditions of Use of the Macadam Platform.
2. DEFINITIONS
In the context of this document, the terms and expressions listed below shall have the meanings assigned to them herein, unless the context clearly indicates otherwise:
Any reference in these Automatic Cashback Terms and Conditions to one gender shall include all genders, and words denoting the singular shall include the plural and vice versa.
2. SERVICE DESCRIPTION
The Automatic Cashback functionality enables the Users to benefit from attractive and personalized Offers based on their consumption habits.
The Application will display to the Users, based on the processing of their transactions history, the Offers for which they are eligible.
When the Automatic Cashback functionality is activated by the User, our partner PayLead receives the User’s daily transactions and 6 months of transactions history. For more information on the processing of Personal Data, User can read the Automatic Cashback Privacy Policy.
After connecting its bank account(s) and activating the Automatic Cashback functionality by accepting these specific terms and conditions, the User has no specific action to initiate : the User will only have to make purchases in store or online, in accordance with Offers conditions, with the Registered Payment Account(s).
During the first use of Automatic Cashback, the User is prompted to connect to its bank via a secure interface and authorize access to the necessary information. Such secure connection will be realized with the intervention of Powens, an European Registered Account Information Service Provider (AISP). This authorization can be revoked at any time through the Application. Please note that revoking an authorization in the middle of a validation process of Coins cause the cancelling of the Automatic Cashbacks in process, resulting in a loss of Coins. Notwithstanding that, this will not have effects over the Coins already validated and available in the Users’ Coins Balance.
2. REWARD AND PAYMENT FLOW
The Automatic Cashback Service operates on an individual Partner basis.
After the Purchase, PayLead will handle the validation of the Purchase. If it is an Eligible Transaction, the User will receive a refund in the form of Coins directly in the Coins Balance within 30 to 90 days, depending on the Partner. During this validation process Macadam may ask the User a Purchase proof.
With the Coins already in the Coins Balance the User will be able to proceed to exchange them for Rewards as established according to Terms and Conditions of Use of the Macadam Platform.
A Cashback can be cancelled if is detected a technical issue, i.e. an associated (partial or total) return of the Purchase during the validation period.
The status of the Cashback can vary as follows:
- Pending: The Cashback has been identified but is waiting for validation (30-90days);
- Validated: The Cashback has been confirmed and is available into the Coins Balance;
- Cancelled: A Cashback may be cancelled if a technical issue is detected or if there is an associated (partial or total) return of the Purchase during the validation period.
3. SUPPORT WORKFLOW
If the validation process outlined in the Offer has expired, if the User has not received the Coins within 90 days of the validation process, or if the Coins received in the Coins Balance do not correspond to the Offer term and conditions, the User may contact Macadam's technical support via Clause 12.11 “Contact” in Terms and Conditions of Use of the Macadam Platform.
The User is informed that, in the event of requesting support through the indicated channel, Personal Data will be processed, in accordance with the Automatic Cashback Privacy Policy. In this regard the User should be aware that, to assist with any Cashback-related incident, Macadam may need to share Personal Data (including proof of purchase) with third-party providers, such as Paylead.
4. DURATION OF SERVICES AND TERMINATION
The functionality of Automatic Cashback can be activated at any time by the User through the Application. The activation of such functionality will be subject to the acceptance by the User of the Automatic Cashback Terms and Conditions and the connection of at least one bank account to the Application.
From the acceptance of the Automatic Cashback Terms and Conditions, the Automatic Cashback Service will remain active until the User revokes its use or the account is closed for any reason outlined in Clause 4.4 “Account Suspension or Closure” of the Terms and Conditions of Use of the Macadam Platform.
The User can revoke the use of the Automatic Cashback Service at any time through the Application.
Any revocation or closure of the User Account will result in the cancellation of any Automatic Cashback transactions in progress if it occurs during an ongoing Coins validation process, leading to the loss of those Coins. However, the revocation will not impact Coins that have already been validated and are available in the User’s Coins Balance.
5. UPDATES NOTIFICATION
Macadam reserves the right to adapt and modify these Automatic Cashback Terms and Conditions at any time and at its sole discretion, without prior notice.
The User will be notified of the modifications through the Application and/or the email address provided when creating their Account. The Automatic Cashback Terms and Conditions and any modifications made to them will take effect immediately from the date of publication online and will be enforceable: - upon acceptance by the User, after registration in the Application and throughout the duration of the use of the services; or - upon 30 days after their communication to the Users, when new Automatic Cashback Terms and Conditions replace them (Opposition Period);Â - on the day of their posting online, in case of a simple update that replaces any previous version. The User may at any time decide to stop using the Automatic Cashback Services or delete its Account but will remain bound by any previous use.
6. ATTRIBUTION SYSTEM
The User may link its bank account(s) to other cashback services that may use PayLead as a technical provider. In such cases, the User may not be eligible to receive Automatic Cashback from the Application for transactions made through those accounts. PayLead will only issue one cashback for each Eligible Transaction. The User cannot choose from which cashback service he wants to be rewarded and the allocation of cashback will be determined according to criteria set by PayLead.
7. LIABILITY AND WARRANTY
The User acknowledges that the Automatic Cashback service provided by Macadam and PayLead may be interrupted for a defined period due to maintenance or technical incidents.
During such periods, access to Macadam services, including Rewards, may be temporarily suspended without notice. PayLead and Macadam will strive to minimize disruptions and restore service as quickly as possible, but they are not liable for any inconvenience caused by such interruptions.
The eligibility criteria of the Purchase(s) will be specified in the Offer(s) featured in the Application and the number of Coins per € spent may be subject to daily, weekly or monthly limits and subject to change. The User is encouraged to regularly review the legal terms of the Offers in order to stay informed of any updates.
Except in specific cases, Partners cannot deactivate or reduce the conditions of an Offer without providing a 14-day notice to Macadam. However, Macadam retains the exclusive right to update or deactivate Offers at any time, without liability, and at its sole discretion.
The User is informed that, even if it is the Partners’ platform, in case an incorrect price is displayed for any product or service, clearly derisory (very low), regardless of the reason (computer, manual or technical error), the order, even if it has been confirmed, may be cancelled and the Coins removed from the User's Account.
Macadam and Paylead are excluded from any liability concerning the purchases of products or services and their delivery. Partners remain solely responsible for the quality, delivery, and performance of the products and services purchased through the Offers.
In any case Macadam’s liability is limited to the extent permitted by applicable law and will not exceed the amounts specified in Clause 9.3 of Terms and Conditions of Use of the Macadam Platform.
